Sex With Betrothal Cases

Dt. 22: 23 If a damsel that is a virgin be betrothed unto an husband, and a man find her in the city, and lie with her; 24 Then ye shall bring them both out unto the gate of that city, and ye shall stone them with stones that they die; the damsel, because she cried not, being in the city; and the man, because he hath humbled his neighbour’s wife: so thou shalt put away evil from among you.


We have a need to recognize the Torah (Old Testament: 1 Timothy 1:8-11) as authoritative and build our communities upon holy, betrothal laws to prevent unchastity among our women. As this verse implies, the virgin daughter is a wife due to the agreement (betrothal) of her father with a man, even though they have not had their wedding and sexual intercourse.

In order for such an agreement to take place, the father of the daughter would be expected to be updated on her cleanliness status. The father would be obligated to inform the bridegroom of anything he might consider a violation of their agreement.

Therefore, the daughter must be taught sexual cleanliness principles from her youth and be able to discuss personal matters with her father. We live in a corrupt society that doesn't encourage close-family relationships, and must struggle to develop our own communities for spiritual protection.

Many of us do not have such healthy family relationships but may still be able to educate and maturate our women so they will be eligible for marriage by being able to offer virginity.

Note this verse also denotes the moral obligation (at that time) for the community to punish severely a violator and a disrespectful daughter: both earned the death penalty. Today, capital punishment is not the appropriate way. The virgin bride could prove her innocence when approached by a wicked violator through vocal expression, screaming and resisting corruption, expecting local people (obviously from a homogeneous racial and cultural society, not a multiracial, multicultural society like we poor Americans suffer) to protect her.

American engagements are not based exactly, if at all in some cases, on the Torah and righteous, Hebrew marriage principles. Such engagements are not seemingly as forceful. So to alleviate for this misfortune, we must adjust the way we raise our daughters so as they are still under spiritual leadership that will protect their chastity and right to perennial care.

If a virgin is a Christian and does not have Christian parents who respect such chastity and care principles, our community can give her spiritual support. She would be obligated to keep herself pure and have positive conversation through the community church, and her groom-to-be would be expected to agree with our holy doctrine and verify his integrity through the virgin's community leaders.

That way, the virgin would have someone (a guardian so to speak) other than the father who is not able to fulfill the needful duty. She would have spiritual guidance and her groom-to-be could be enlightened. Final legal instruments could be made through a community approved lawyer.

Although the New Testament recognizes the O.T. law but many countries and states do not, our youth may have sufficient direction through our discipleship and leadership. With such good understanding of marital principles among our Christian fellowship, it would be much more difficult for violators to bring in sexual corruption and posterity destruction. Thus, it would be a sin for a man to even consider breaking such engagements among our virgin daughters and their grooms.

The endowment law (Ex. 22:16) helps us understand the violation of chastity commandment of Dt. 22:21. The father is expected to have a trust relationship (faith in her obedience) with his daughter. He expects her to remain a virgin and if she doesn't, she is to notify him so that he may collect his endowment and choose whether to give her away in marriage or to keep her single.”
